GENERAL TERMS AND CONDITIONS OF SALE:

PRICE:
All prices as listed on our website www.kitchenshop.co.za have been approved by the Export Department of Rangemaster and Aga-Rayburn. Prices for the Products are those that apply at the date the deposit is paid, notwithstanding the date of order or invoice, the intent being that if the deposit is not paid timeously The Kitchen Shop reserves the right to alter the prices to take into account changes in market conditions.

ORDERS:
The order of goods is in accordance with The Kitchen Shop's ordering procedure as set out here. All orders are subject to: (1) Sales order as of acceptance by The Kitchen Shop and (2) Payment of a 50% deposit and (3) Balance is payable as soon as the goods are received at our warehouse. If the goods are in stock at the date of order, then they must be fully paid up at the time of order. If an order is cancelled, then The Kitchen Shop reserves the right, at our discretion, to keep part or all of the deposit to defray any costs or damages including but not limited to interest, storage and any other costs arising out of the cancellation of the order.

DELIVERY:
Delivery will be arranged at the customers request, and will only occur once full payment is received. Under no circumstances will any exceptions be made. All goods remain the property of The Kitchen Shop (Pty) Ltd until fully paid for.
While The Kitchen Shop shall use its best endeavours to adhere to an estimated date of delivery as per the sales order, it shall not be bound by such date and accepts no responsibility for any loss, expense or damage of whatsoever nature that may result from any delay.
The price excludes delivery, installation and the cost of preparing the site, casting plinths, carpentry, electrical or gas line to the cooker and the flue/chimney/hood installation.
Delivery will only be made once the electrics and the gas line to the cookers have been installed and the kitchen cabinetry is complete. On delivery our installer must be able to put the cooker in position and test it working. If this is not possible or the cooker is not installed by one of our approved installers, then the warrantee may be void and a call out fee including travel will be charged.

On delivery our installer will convert the gas jets from British standard to South African standard. The installer must be able to assemble the cooker (where applicable) and put the cooker in its position. If this is not possible or the cooker is not installed by one of our approved installers, then the warrantee may be void and a call out fee including travel will be charged. Our installer is not responsible to connect the cooker to the gas or the electric connection. This must be done by the clients own certified gas installer and electrician.

Delivery is 8-12 weeks, estimated from the date of order confirmation.

OWNERSHIP:
The Kitchen Shop shall retain ownership of all the Products until such time as The Kitchen Shop has received payment in full, in cash or cleared funds, of all amounts owing to The Kitchen Shop by the Customer on any account whatsoever. Notwithstanding the reservations of ownership as set out above, all risk in and to the Products shall pass to the Customer upon delivery of the Products to the Customer.

LATE PAYMENT, APPLICABLE LAW AND JURISDICTION
In the event of The Kitchen Shop instructing attorneys to collect from the Customer an amount owing to The Kitchen Shop, the Customer agrees to pay all costs on the scale as between attorney and own client, including collection commission and tracing charges. The Customer hereby consents to the jurisdiction of the Magistrate's Court having jurisdiction over its person, notwithstanding that the cause of action and/or the amount of its claim may exceed or be beyond the jurisdiction of that Court. The Kitchen Shop shall, at its discretion, be entitled to proceed against the Customer in any other court of competent jurisdiction, notwithstanding the aforegoing.
